BOLT MOBILE APP TERMS AND CONDITIONS

I-Charge Solutions International Company Limited. (一里通國際有限公司)
The "App" shall mean Bolt, the software provided by I-Charge Solutions International Company Limited. (一里通國際有限公司) (“I-Charge Solutions) to offer services related to facilitating EV drivers to locate, reserve and pay for EV charging stations within Hong Kong SAR via their mobile phones for its members, to be used on iOS and/or Android devices and any upgrades from time to time and any other software or documentation which enables the use of the App.
3 Account Registration and Obligations
In consideration of your use of the Service, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or I-Charge Solutions has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, (c) violate Condition of Use set out in Section 7 (below), I-Charge Solutions has the right to suspend or terminate your account and refuse any and all current or future use of the Service and confiscate Deposits in your account (or any portion thereof).
4 Data Protection
5 Account, Password and Security
You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify I-Charge Solutions of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. I-Charge Solutions cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
6 Bolt Users Conduct
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not I-Charge Solutions, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. I-Charge Solutions does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
7 The App
The App allows you to access certain functionalities available on the I-Charge Solutions website. Such access will be governed by the I-Charge Solutions Conditions of Use.
8 Proprietary Rights and Licence
8.1 All trade marks, copyright, database rights, and other intellectual property rights of any nature in the App together with the underlying software code are owned directly either by I-Charge Solutions or by I-Charge Solutions’ licensors.
9 Conditions of Use
9.1 You will not, nor allow third parties on your behalf to:
(a) make and distribute copies of the App;
(b) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, or translate the App; or
(c) create derivative works of the App of any kind whatsoever.
(d) continue to occupy the EV charging facilities when the reservation expires. In the event your EV continues to occupy the charging facilities after the reserved timeslot, you agree and allow I-Charge to deduct a reasonable amount from the Deposit in your membership account.
(e) "stalk" or otherwise harass another user or general public using the Report function; and/or
(f) collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through l above
9.2 I-Charge Solutions reserves all rights to suspend, amend, cancel the bonus point /coupons and also has the right to terminate any login account and confiscate Deposit associate the membership account without prior notice.
9.4 You acknowledge that the terms of agreement with your respective mobile network provider (the “Mobile Provider”) will continue to apply when using the App. As a result, you may be charged by the Mobile Provider for access to network connection services for the duration of the connection while accessing the App or for any such third party charges as may arise. You accept responsibility for any such charges that arise.
9.5 If you are not the bill payer for the mobile telephone or handheld device being used to access the App, you will be assumed to have received permission from the bill payer for using the App.
9.6 You also understand and agree that the Service may include advertisements and that these advertisements are necessary for I-Charge Solutions App to provide the Service. You also understand and agree that the Service may include certain communications from I-Charge Solutions App, such as service announcements, administrative messages and the I-Charge Solutions Newsletter, and that these communications are considered part of I-Charge Solutions membership and you will not be able to opt out of receiving them.
9.7 You acknowledge and agree that I-Charge has the rights to revise, from time to time, in part or in whole, BOLT MOBILE APP TERMS AND CONDITIONS at its sole discretion with or without written notification to you.
10 Terms and Conditions for Online Booking Transaction
10.1 When you reserve and pay for EV charging station(s) through the App, our systems process your transaction and obtain credit card authorization immediately during the log-in. This updated Internet site makes use of our proven systems as well as a number of important security measures to further protect you:
10.2 Before you can make reservations, we ask that you register with us, providing some personal information as well as specifying the credit card information to use for your transactions.
10.3 Using your account ID and password, you need not enter your credit card information every time you use our services, reducing the amount of encrypted information exchanged during and speeding up each transaction.
10.4 You acknowledge and agree that all booking transactions are non-refundable if booking is cancelled within 24 hours to the booking time. You also acknowledge and agree that all booking transactions that are cancelled more than 24 hours will receive 50% refund of the original booking fee.
10.5 We ask for your daytime telephone number, and fax number if you have one, so that if we detect unusual transaction activity or encounter any problems with your order we are able to contact you.
10.6 You agree and allow I-Charge Solutions to collect a deposit ("Deposit") from you, which we will hold as security.
10.7 The amount of the Deposit shall be of such reasonable amount as determined and announced by us from time to time to cover the cost for providing a negative value feature (if applicable).
10.8 When you cancel your membership and apply for a refund, the Deposit, if applicable, and the remaining value, if any, stored in your account will be refunded to you in full except in the following situations when we may deduct a reasonable amount to cover: (i) any negative remaining value on your account. (ii) any breach of the Condition of Use.
10.9 All registration information is sent to our secure computer through a protocol called Secure Sockets Layer (SSL). SSL encrypts your data communications with us so they are unreadable in transit over the Internet.
10.10 Once it reaches us, registration information is stored on an isolated computer that is NOT directly connected to the Internet. It sits behind a firewall that ensures your sensitive information is not available to unauthorized access.
10.11 If this English version of Terms and Conditions does not conform to the Chinese version, the English version shall prevail.
10.12 You understand and agree that I-Charge has the rights to revise this Terms and Conditions for Online Booking Transaction from time to time at its sole discretion.
11.1 This App is available to handheld mobile devices running iOS and/or Android. I-Charge Solutions will use reasonable efforts to make the App available at all times. However, you acknowledge the App is provided on the Internet and on mobile networks, so the quality and availability of the App may be affected by factors outside I-Charge Solutions 's reasonable control.
11.2 I-Charge Solutions, its group of companies, and its sub-contractors do not accept any responsibility whatsoever for unavailability of the App or any difficulty or inability to download or access content or any other communication system failure which may result in the App being unavailable.
11.3 I-Charge Solutions will not be responsible for any support or maintenance for the App.
12 System Requirements
12.1 In order to use the App, you are required to have a compatible mobile telephone or handheld device, Internet access, and the necessary minimum specifications (the “Software Requirements”).
12.2 The Software Requirements are as follows: the app requires the device to be running iOS7 or Android 5.0 Lollipop or later version, and has the ability to access on the Internet or mobile networks.
12.3 The version of the App software may be upgraded from time to time to add support for new functions and services.
13.1 I-Charge Solutions may terminate use of the App at any time by giving notice of termination to you.
13.2 Upon any termination:
(a) the rights and licences granted to you herein shall terminate; and
(b) you must cease all use of the software immediately.
14 Limitation of Liability
14.1 In no event will I-Charge Solutions be liable for any direct, indirect, special, punitive, exemplary, or consequential losses or damages of whatsoever kind arising out of your use of or access to the App and/or the EV charging equipment at the reserved site, including loss of profit or the like whether or not in the contemplation of the parties or whether based on breach of contract, tort (including negligence), product liability, or otherwise.
14.2 I-Charge Solutions is not liable to you for any damage or alteration to your equipment, including but not limited to computer equipment, handheld devices, or mobile telephones, electric vehicle(s), charging equipment, etc., as a result of the installation or use of the App.
14.3 I-Charge Solutions is not liable to you for death or personal injury caused by inappropriate use of the App and/or the EV charging equipment at the reserved site.
15 Disclaimer of Warranties
To the maximum extent permitted by law, and for the avoidance of doubt, I-Charge Solutions hereby disclaims all implied warranties with regard to the App. The App, software and service are provided "as is" and "as available" without warranty of any kind.
